Economic Benefit Analysis

Economic benefit of noncompliance in environmental civil enforcement cases. EcoShelf has presented detailed models and calculations for the economic benefit of alleged noncompliance in several penalty settlement cases involving actions by USEPA and the USDOJ. We have worked on cases involving virtually all areas of environmental regulation and on complex scenarios in various manufacturing and energy production industries.

Representative matters and experience include:
  • Stormwater compliance, including implementation of BMPs
  • Wastewater treatment and upgrades involving a number of categorical pre-treatment standards, e.g., including OCPSF, pharmaceutical, incineration, minerals processing and mining
  • Air pollution control, involving baghouses, scrubbers, electrostatic precipitators, etc.
  • Cost of implementation of environmental management systems as a compliance tool
  • Compliance with RCRA and hazardous waste management regulations
  • Calculations for the "repair and replace" components for NSPS trigger determinations.
We have experience in setting up economic calculations under a variety of scenarios commonly encountered in real-life industrial situations, e.g.:

  • Shifting production to another plant with excess capacity, among others.
Valuation of Supplemental Environmental Projects. EcoShelf assists in the identification of relevant projects and conducts valuation of SEPs proposed for implementation as an offset for penalties in environmental civil enforcement cases. We have completed and presented detailed economic analyses on complex SEP implementation in a variety of cases, including water, air and hazardous waste landfill closure, among others.
